The terms and conditions outlined below (“Terms and Conditions”) govern the Fairmont President’s Club Program (the “Program”) operated by FRHI Hotels & Resorts S.à r.l., a société à responsabilité limitée, with registered office at 8-10, avenue de la Gare, L-1610 Luxembourg, Grand-Duchy of Luxembourg, having a share capital of EUR 38,690,125, R.C.S. Luxembourg B 110 245,(“Fairmont”).  By enrolling as a member of the Program (“Member”) and participating in the Program, the Member agrees:

  • That he/she has fully read, understands, and accepts these Terms and Conditions; 
  • That he/she has fully read, understands, and accepts the terms of website use; 
  • That he/she has fully read and understands Fairmont’s privacy policy and consents to Fairmont’s use of the Member’s personal information as described by and in accordance with Fairmont’s privacy policy; and  
  • That his/her adherence to these Terms and Conditions does not constitute a genuine and determinant condition to the booking of available rooms or participation in other offered activities at any Participating Hotel (as defined below). 
Fairmont President’s Club Program Overview 
  • A Member may only enjoy his/her membership status, services and other benefits in accordance with these Terms and Conditions.  A Member has no property or ownership interest in his/her membership status, services or other benefits.  Membership status, services and benefits associated with the Program are the sole property of Fairmont. 
  • Fairmont reserves the right to add, modify or delete benefits or tier-level qualifications at its sole discretion, with or without notice.  
  • The Program is an individual recognition program.  Program membership is for individual use only. The membership and associated benefits are for the sole use of that member; membership is nontransferable. Memberships cannot be shared by more than one person, or combined with other memberships.  
  • Members are required to update Fairmont with any changes to personal information that could affect their membership.  
  • Club-level membership has no expiry date.  
  • The qualifying period to achieve stays/room nights (for Premier and Platinum membership) is based on a calendar year for renewal purposes.  
  • Premier and Platinum membership certificates are active until the end of February each year, except where prohibited by law. At that time, membership will be renewed with full benefit entitlement, based on stays/room nights achieved during the previous calendar year. Benefits do not carry over from one membership year to the next.  If a Member achieves Premier or Platinum membership status before September 30, all benefits and privileges of the associated status will be in effect immediately; a member kit will be sent to those Members who have a valid mailing address on their profile.   Existing Premier and Platinum Members who do not make the necessary tier criteria within the calendar year will be downgraded to the appropriate tier level.  
  • It is the Member’s responsibility to report a lost or stolen credit card or membership card.  
  • Fairmont reserves the right to request a Member’s membership card, along with photo ID, at any time during his/her stay.  
  • Fairmont has the right to restrict benefits and discontinue a Member’s profile.  
  • Members are required to provide their Program number at time of reservation. Members who do not know their Program number at time of reservation will be requested to provide an additional piece of information. At check-in, Members may be required to provide their Program number and photo ID.
Earning Fairmont President’s Club, Premier or Platinum Status 
  • To receive stay and or room night credit toward Premier or Platinum status, a Member must be a registered guest of the Participating Hotel and stay overnight. Stay and or room night credits and benefits of the Program can only be applied to the individual Member who enrolled in the Program and that individual Member who is a registered guest of the Participating Hotel.
  • A stay is defined as consecutive nights in the same Participating Hotel, regardless of the number of check-ins/checkouts that may occur. Members must reserve the room in their name, provide their Program number and stay overnight. When a Member books multiple rooms, only the room occupied by the Member will be counted for stay and or room night credit towards the Member's status.
  • Stay and or room night credit for the Program is for individual travel only. Only one Member will receive credit for a stay, regardless of the number of Members in the room. To receive a stay credit or room night credit, the reservation must be booked on qualifying rates.  
  • Stays or room nights occurring prior to enrollment may be applied from the beginning of the current calendar year, January 1.  Members must contact the Program’s Guest Services Team to have these stays credited to their profile.
  • Stay or room night credit is not applicable to condominiums, marinas or apartments at Fairmont Hotels & Resorts properties.
  • The Program will not grant tier status based on performance or status in other hotel loyalty programs.
  • Members who stay on qualifying rates at Raffles Hotels & Resorts and Swissôtel Hotels & Resorts will have those stays counted towards membership status when their Program membership number is included on their reservation. Stay credit will be awarded based on the qualifying rate requirements of the brand where the stay took place.

Fairmont President’s Club Premier     

Fairmont President’s Club Premier membership will be awarded to members with 5 stays or 10 room nights per calendar year (January 1 to December 31).   

Fairmont President’s Club Platinum 

Fairmont President’s Club Platinum membership will be awarded to members with 10 stays or 30 room nights per calendar year (January 1 to December 31). 


Fairmont President’s Club Certificates 

Room Upgrade Certificate    

Redemptions of Room Upgrade Certificates (together with Suite Upgrade Certificates, Third Night Complimentary Certificates, Complimentary Night Certificate and Complimentary Dining/Willow Stream Spa Certificates, “Certificates”) by holders of the Certificates (“Holder”) are subject to the following terms, conditions and restrictions.   Certificates will be added to a Member’s online profile at fairmont.com/fpc.  No paper certificates or email certificates will be issued.   Each Certificate entitles the Holder to one complimentary room upgrade, single/double occupancy, at any Participating Hotel.  The Holder will be upgraded from the room category purchased to the next available room category, excluding Suites, Fairmont Gold room, Fairmont Gold Junior Suites and Fairmont Gold Suites.  Certificates may not be used as credit towards Suites, Fairmont Gold room, Fairmont Gold Junior Suites or Fairmont Gold Suites.  Specific rooms are subject to availability; blackout dates and limited access may apply.   For purposes of these Terms and Conditions, a “stay” is defined as consecutive nights in the same Participating Hotel, regardless of the number of check-ins/checkouts that may occur.  Only one Certificate may be used per stay.  A stay cannot exceed five (5) nights.  Certificates may not be used at Fairmont Heritage Place Residences, The Plaza Hotel or The Fairmont Royal Pavilion.  Certificates may only be applied with advance notice provided to the Program Concierge at the time of reservation.  Certificate use is subject to availability. Certificates are redeemed at check-in.  If a Member requests that a Certificate be used at the time of reservation, but there is no Certificate available in the Member’s online profile at check-in, the Member will be responsible for full payment of all room, tax and other applicable charges.  For black-out dates and limited access, information, please click here.  Charges for additional adults (i.e. over two adults) in the room will apply.  Certificates cannot be used prior to March 01 of the issuing year.  If permitted by law, Certificates will expire on February 28 or 29of the following year.  Certificates are non-transferable, except by Platinum Members, who may transfer Certificates to immediate family members over the age of 18 who are also Members. For purposes of these Terms and Conditions, “immediate family” means parents, adult children, spouses (including domestic partners) and siblings.  Platinum Members wishing to transfer a Certificate to an immediate family may do so through their online profiles.   Family members will not be able to access or use Certificates directly on or from the Platinum Member’s profile.  Certificates will be void if listed or advertised for sale or auction on the Internet, in newspapers and magazines, or other similar means.  Fairmont reserves the right to remove or deny without notice any Certificate it believes has been resold, transferred or conveyed contrary to this provision or otherwise acquired in error or under questionable means.  Certificates may subject Holders to income or other taxes.  Certificates are not eligible for redemption on travel-industry rates, airline crew rates, travel agent rates, tour group escort stays, packages or promotions. 


Suite Upgrade Certificate   

Redemptions of Suite Upgrade Certificates by are subject to the following terms, conditions and restrictions.  Certificates will be added to a Member’s online profile at fairmont.com/fpc.  No paper certificates or email certificates will be issued.  Each Certificate entitles the Holder to one complimentary Suite upgrade, single/double occupancy, at any Participating Hotel.  Holder will be upgraded from the room category purchased to the Participating Hotel’s designated Suite category.  Certificates are applicable from Fairmont Standard room category and above and not applicable for Fairmont Gold room, Fairmont Gold Junior Suites or Fairmont Gold Suites.  Certificates are not applicable for specialty Suites or multi-unit Suites.  Certificates may not be used as credit towards Suites, Fairmont Gold room, Fairmont Gold Junior Suites or Fairmont Gold Suites.   Specific rooms are subject to availability; blackout dates and limited access may apply.  Only one Certificate may be used per stay.  Stays cannot exceed five (5) nights.  Certificates may not be used at Fairmont Heritage Place Residences, Fairmont Makati, The Plaza Hotel, The Fairmont Royal Pavilion, Fairmont Tremblant, The Fairmont Vancouver Airport or The Savoy.  Certificates may only be applied with advance notice provided to Fairmont President’s Club Concierge at the time of reservation.  Certificate use is subject to availability.  Certificates are redeemed at check-in.  If a Member requests that a Certificate be used at the time of reservation, but there is no Certificate available in the Member’s online profile at check-in, the Member will be responsible for full payment of all room, tax and other applicable charges.  For black-out dates and limited access, information, please click here.  Charges for additional adults (i.e. over two adults) in the room will apply.  Certificates cannot be used prior to March 01 of the issuing year.  If permitted by law, Certificates will expire on February 28 or 29of the following year. Certificates are non-transferable, except by Platinum Members, who may transfer Certificates to immediate family members over the age of 18 who are also Members. Premier Third Night Complimentary Certificate   

Redemptions of Premier Third Night Complimentary Certificates are subject to the following terms, conditions and restrictions.  Certificates will be added to a Member’s online profile at fairmont.com/fpc.  No paper certificates or email certificates will be issued. Each Certificate entitles the Holder to one complimentary third night free, single/double occupancy Fairmont Standard Guest Room (two adults, excludes Deluxe, Signature, Junior Suites, Suites, Fairmont Gold room, Fairmont Gold Junior Suites, Fairmont Gold Suites) at any Participating Hotel.  Specific rooms are subject to availability; blackout dates and limited access may apply.  Certificates may only be used when the Member pays for the first two nights of a three-night stay at the Participating Hotel.  Certificates may not be used in conjunction with a Platinum Complimentary Night Certificate or any other Fairmont or third-party promotions or packages. In addition, Certificates may not be used as credit towards Fairmont Gold Rooms or Suites or at Fairmont Heritage Place Residences. Certificate use at The Savoy is limited and subject to availability.   Certificates may only be applied with advance notice provided to the Program Concierge at the time of reservation and when three consecutive nights are booked as part of a stay.   Certificate use is subject to availability. Certificates are redeemed at check-in.  If a Member requests that a Certificate be used at the time of reservation, but there is no Certificate available in the Member’s online profile at check-in, the Member will be responsible for full payment of all room, tax and other applicable charges.   For black-out dates and limited access information, please click here.  Charges for additional adults (i.e. over two adults) in the room will apply. Certificates are valid for room and tax only and may not be applied to resort fees, incidentals and other service charges, which charges may apply.   Certificates cannot be used prior to March 01 of the issuing year.  If permitted by law, Certificates will expire on February 28 or 29of the following year.   Certificates are nontransferable.  Certificates will be void if listed or advertised for sale or auction on the Internet, in newspapers and magazines, or other similar means.  Fairmont reserves the right to remove or deny without notice any Certificate it believes have been resold, transferred or conveyed contrary to this provision or otherwise acquired in error or under questionable means.  Certificates may subject Holders to income or other taxes.  Certificates are not eligible for redemption on travel-industry rates, airline crew rates, travel agent rates, tour group escort stays, packages or promotions. 

 

ADDITIONAL TERMS FOR THE PLAZA: Only one Certificate may be redeemed per stay at The Plaza Hotel, New York City, USA. In addition, a Certificate redeemed at The Plaza Hotel may not be combined with any other room-type certificates (suite upgrade, room upgrade, etc.), any other certificates offered in connection with the Program, nor with any other Fairmont or third-party packages and promotions. 

 

Platinum Complimentary Night Certificate  

Redemption of Platinum Complimentary Night Certificates are subject to the following terms, conditions and restrictions.  Certificates will be added to a Member’s online profile at fairmont.com/fpc.  No paper certificates or email certificates will be issued. Each Certificate entitles the Holder to one complimentary single/double occupancy Fairmont Standard Guest Room (two adults, excludes Deluxe, Signature, Junior Suites, Suites, Fairmont Gold room, Fairmont Gold Junior Suites, Fairmont Gold Suites) at any Participating Hotel. Specific rooms are subject to availability; blackout dates and limited access may apply.  Except as set forth below, more than one Certificate may be used together in a single stay.  Certificates may also be used in conjunction with a Room or Suite Upgrade Certificate.  Certificates may not be used in conjunction with a Premier Complimentary Third Night Certificate or any other Fairmont or third-party promotions or packages.  In addition, Certificates may not be used as credit towards Fairmont Gold Rooms or Suites or at Fairmont Heritage Place Residences. Certificate use at The Savoy is limited and subject to availability.  Certificates may only be applied with advance notice provided to the Program’s Concierge at the time of reservation. Certificate use is subject to availability.  Certificates are redeemed at check-in.  If a Member requests that a Certificate be used at the time of reservation, but there is no Certificate available in the Member’s online profile at check-in, the Member will be responsible for full payment of all room, tax and other applicable charges.  For black-out dates and limited access information, please click here.  Charges for additional adults (i.e. over two adults) in the room will apply. ADDITIONAL TERMS FOR THE PLAZA: Only one Certificate may be redeemed per stay at The Plaza Hotel, New York City, USA. In addition, a Certificate redeemed at The Plaza Hotel may not be combined with any other room-type certificates (suite upgrade, room upgrade, etc.), any other certificates offered in connection with the Program, nor with any other Fairmont or third-party packages and promotions. 

 

Complimentary Dining/Willow Stream Spa Certificate   

Redemption of Complimentary Dining/Willow Stream Spa Certificates are subject to the following terms and conditions.  Certificates will be added to a Member’s online profile at fairmont.com/fpc.  No paper certificates or email certificates will be issued.  Certificates entitle Holders to $25 USD credit towards lunch, dinner or a Willow Stream Spa treatment.  Certificates are redeemable at all participating restaurants located at or in any Participating Hotel, excluding all Fairmont Heritage Place Residences.   Certificate use is subject to availability; blackout dates and limited access may apply.  Certificates may be applied to tax; but not to alcohol and gratuities.  Holders are responsible for settling any outstanding amount once the $25 USD has been credited.  Any unused portion of the Certificates will be forfeited, unless otherwise required by law.  Holders must communicate their request to use the Certificate to their server or spa attendant upon being seated in the restaurant or arriving at the Willow Stream Spa.  Holders will also need to provide the Program Member number to the server before redeeming the Certificate, at which time he/she may be asked to present their membership cards.  If a Member requests that a Certificate be used, but there is no Certificate available at time of redemption in the Member’s online profile, the Member will be responsible for full payment of all dining or spa charges. For participating restaurants where the Certificate will be accepted, please click here.  For a complete listing of Willow Stream or Fairmont Spas, please click here.  Certificate use is subject to availability.  For black-out dates and limited access information, please click here.  Certificates may be used in conjunction with any other room certificates offered in connection with this Program, but not in conjunction with any other Fairmont or third-party package or special offer and the Certificates may not be used for in-room dining or in-room spa treatments. Certificates will be exchanged into local currency based on the daily exchange rate for the applicable currency, as measured by the Participating Hotel.  Certificates cannot be used prior to March 01 of the issuing year.  If permitted by law, Certificates will expire on February 28 or 29of the following year. Certificates are non-transferable, except by Platinum Members, who may transfer them to immediate family members over the age of 18 who are also Members. Platinum Members wishing to transfer Certificate to immediate family may do so through their online profiles.   Family members will not be able to access or use a Certificate directly on or from the Platinum Member’s profile.  Certificate will be void if listed or advertised for sale or auction on the Internet, in newspapers and magazines, or other similar means.  Fairmont reserves the right to remove or deny without notice the redemption of any Certificate it believes have been resold, transferred or conveyed contrary to this provision or otherwise acquired in error or under questionable means.  Certificates may subject Holders to income or other taxes. 

 

Fairmont President’s Club  Benefits

  • Benefits are provided to Members only when they are registered guests of a Participating Hotel.  
  • Club-level Members will begin to receive in-hotel benefits during their next stay (following enrollment in the Program).  
  • Fairmont reserves the right to add, modify or delete tier-level benefits at its sole discretion, with or without notice.  
  • Standard high-speed internet access is complimentary for Members. A minimal fee may apply for Club level Members only for premium high-speed internet access in select hotels. Premier and Platinum Members receive Premium access free of charge. Complimentary high-speed Internet access applies to daily in-room usage only and is not applicable to in-room television Internet service or hotel work centers.  Members must be among the registered guests of the hotel or resort to receive complimentary high-speed Internet access.  
  • Complimentary health club privileges are available to Members when staying as a registered guest of a Participating Hotel. This privilege applies to in-hotel health clubs only and excludes Willow Stream Spa health clubs. This privilege applies to Members only.  
  • Members staying as registered guests of a Participating Hotel receive 10% off treatments and products at Willow Stream Spas or The Spas at Fairmont.  Discount may not be combined with other discounts, including, but not limited to, those provided to Fairmont Heritage Place owners or to those guests staying on a spa group contract.   • Fairmont Fit is a benefit associated with the Program. Only registered guests of a Participating Hotel who are Members are able to use this and all other benefits. The Fairmont Fit benefit may change or be canceled at any time without notice. This benefit offers Members the use of workout clothing, shoes, yoga mats and stretch bands. All items used (except socks) must be returned as to not incur charges. Yoga mats and stretch bands are to be returned in the same condition as borrowed as to not incur charges. A service fee will apply to all Club-level Members for the use of Fairmont Fit.  
  • Upon presentation of a Program membership card, Members are entitled to a discount of 15% at The Fairmont Store or Boutique Fairmont.  Such discount applies only to regularly priced Fairmont-branded products. The discount does not apply to convenience, sundry, confectionery products, Fairmont Ovation Rewards, Fairmont gift certificates and Le Labo products. The discount does not apply to on-sale, marked-down items or online purchases.  Maximum discount per transaction is equivalent to $1,000 in local currency. Discount is not valid for online purchases at fairmontstore.com.   
  • To receive Frequent Flyer "miles", reservations must be booked on qualifying rates.  To see a listing of current Frequent Flyer partners, also visit fairmont.com/fpc.  Retroactive credit for bonus Frequent Flyer miles earned as a benefit of being a Member will not be issued for stays that occurred prior to enrolling in the Program.   
  • Guaranteed room access is provided to Platinum Members at Participating Hotels in city locations only, when reservations are made 72 hours prior to 4:00 p.m. local time on intended day of arrival and are reserved with a valid credit card. When a Participating Hotel is completely sold out of all guestrooms, the hotel shall make available a Fairmont Standard Guest Room (two adults, excludes Deluxe, Signature, Junior Suites, Suites, Fairmont Gold rooms, Fairmont Gold Junior Suites and Fairmont Gold Suites) at the sell rate of the day. In the event that the Member does not arrive as scheduled, or does not call to cancel as per the hotel’s cancellation policy and does not have a cancellation number, the credit card will be charged one night’s room and tax. Guaranteed room access applies to one room only and must be occupied by the Member. Guaranteed Room Access does not apply during blackout periods.   • The Fairmont President’s Club Stay More Earn More program is available only to Platinum Members.  Complimentary night certificates will be added to the qualifying Member’s profile online at fairmont.com/fpc.  No paper certificates or email certificates will be issued.  In order to qualify, the Member must have met the necessary Stay More Earn More production criteria.   Member must be checked out of the hotel in order to have their stay recorded and to receive their complimentary night certificate.  Certificates could take up to seven (7) days after check out to appear on the Members profile.  If permitted by law, Certificates awarded under the Stay More Earn More program will expire 365 days from date of issue.  All other terms and conditions associated with the regular Platinum Complimentary Night Certificates will apply.  The Stay More Earn More benefit does not apply to Members who are registered live-in guests of a Fairmont hotel or resort, or who stay more than 30 consecutive nights at one hotel or resort regardless of the number of check-ins/check-outs that may occur.  
  • Great Rates - Great Dates is offered exclusively to Members.  A Member’s Program number is required at time of booking.  The Great Rates, Great Dates offer allows each Member the benefit of booking up to two rooms per stay period.  Great Rates must be booked within the seven-day time period allowed.  Offer is subject to availability and limited blackout dates at time of reservation for double occupancy in a Fairmont room.  Offer may not be combined with other promotions or offers.  Full, non-refundable payment is required at time of booking.   
  • Members may reserve a complimentary set of TaylorMade golf clubs seven (7) days in advance of their arrival at Participating Hotels, subject to availability.  Please visit fairmont.com/fpc/taylor-made-for-you for a listing of where TaylorMade golf clubs are available.  Members must be a registered guest of a Participating Hotel to enjoy this benefit.  Members must sign a waiver upon acceptance of TaylorMade golf clubs and are liable for loss, breakage and damage.  Members may reserve a set of TaylorMade golf clubs no more than seven (7) days prior to arrival.   TaylorMade golf clubs are available to Members on a first come-first serve basis with no monetary compensation if TaylorMade golf clubs are not available.   When reserving clubs, a Member will be offered a 3-hour window for pick-up (i.e. 6:00 a.m. to 9:00 a.m., 9:00 a.m. to 12:00 p.m., 12:00 p.m. to 3:00 p.m.) or the TaylorMade golf club rental will be forfeited that day.   TaylorMade golf clubs must be returned by end-of-day.   TaylorMade golf clubs may be reserved more than one time for extended stays. 
  • Members may enjoy complimentary use of BMW bikes and vehicles based on availability at Participating Hotels and may not be reserved in advance of arrival at the hotel.  Vehicles are made available to Members to be driven to nearby business meetings, restaurants and local attractions.   
  •  Two-for-one golf benefit is open to all current Premier and Platinum Members.  Redemption of Two-for-One Golf Certificates by Holders is subject to the following terms and conditions. Certificates entitle the Holder to one complimentary round of golf (18 holes) when purchasing one round of golf at full rate.   Certificates are redeemable at participating locations.  Visit fairmont.com/fpc/two-for-one-golf for participating locations.  Certificates may only be applied with advance notice provided to the Program Concierge at the time of reserving tee-time.  Certificate use is subject to availability.  Original Certificates must be provided at Golf Clubhouse at time of check-in.  Tee off times are subject to availability at time of booking.  One certificate redeemable per stay per Premier or Platinum Member.  Certificates must be redeemed at the property indicated on the certificate front.  The complimentary round of golf cannot be played at a later date.  Certificates are non-transferable and can only be used by the Member.

General Terms and Conditions  

  • Membership in the Program is complimentary and is available to individuals residing in countries that legally permit participation in frequent-stay programs.  Membership in, and application for, the Program is void if prohibited by law in the country of the Member’s or applicant’s domicile.   
  • Members of the Program must be at least 18 years of age. Personal identification, with date of birth for verification purposes, may be required upon check-in.   
  • Program membership and its benefits are offered at the sole discretion of Fairmont.   
  • Colleagues of Fairmont and any other of its affiliates are eligible to participate in the Program, but they will not receive stay credits toward elite levels or any benefits of the Program.  For a complete list of guidelines for colleagues, please refer to the Fairmont Hotels & Resorts Colleague Policy.   
  • The Program has no predetermined termination date and may continue until, at any time, Fairmont decides to terminate the Program, with or without notice. Members will have six (6) months from the date the Program is terminated to redeem a valid certificate.   
  • Fairmont reserves the right to unilaterally add, modify, delete or otherwise change any of the terms, rules, procedures, conditions, benefits, rewards or reward levels pertaining to the Program at its sole discretion, with or without notice, even though changes may affect the value of reward certificates already issued. This means that Fairmont may make changes that affect, but are not limited to, travel partner affiliations, rules and procedures for the use of benefits, continued availability of awards, blackout dates, room availability, benefit types and the features of special offers.   Fairmont shall provide notice of a substantial addition, modification, deletion, or other substantial change in these Terms and Conditions to a Member’s email address or physical mailing address in addition to posting such changes to the Program’s website.  A Member’s continued participation in the Program constitutes a Member’s acceptance of any such additions, modifications, deletions, or changes.
  • Fairmont reserves the right to revoke, suspend or discontinue Program membership for any Member at any time upon written notice to the Member, for any reason, and in Fairmont’s sole discretion, including, without limitation, (i) use the Program in a manner inconsistent with these Terms and Conditions, or the intent of the Program or any one of the Program benefits offered, including, but not limited to, reward redemption or certificate use; (ii) engaging in unruly behavior or conduct unbecoming of a guest of a luxury hotel or resort; or (iii) acting in a manner inconsistent with local or federal laws, statutes or ordinances.   
  • Fairmont further reserves the right to revoke, suspend or discontinue Program memberships based on unsettled accounts, NSF checks or a discrepancy with Program memberships until accounts have been settled or the issue has been resolved.   
  • Discontinued membership may result in the cancellation of benefits and privileges. In addition to discontinuance of the Program, Fairmont shall have the right to take appropriate administrative and/or legal action, including, without limitation, criminal prosecution, as it deems necessary in its sole discretion.   
  • All interpretations of these Terms and Conditions shall be at the sole discretion of Fairmont.   
  • Each Member is responsible for advising Fairmont of any address changes or change of credit card information. Fairmont is authorized to bill any charges incurred by the Member at any hotel owned or managed by Fairmont or its affiliates that takes part in the Program (each, a “Participating Hotel”), to any credit card number the Member provides.   
  • Specific Program benefits and services have been established for all Members; however, benefits and services offered by Participating Hotels may vary.   
  • Benefits and services, including, without limitation, Certificates, have no cash value and Fairmont will not compensate or pay cash for any forfeited, unused or lost benefits or services.  Benefits and services are the sole property of Fairmont and a Member has no property interest in any benefits or services. 
  • Fairmont is not responsible, and assumes no liability, for changes or discontinuation of third party partner products and/or services, which may affect the Program.   
  • Fairmont reserves the right to limit membership benefits, airline miles, stay and room night credits to qualifying room rates.  Qualifying rates are determined by Fairmont in its sole discretion and can be deemed non-qualifying at any given time without prior notice. Travel-industry rates (including, but not limited to airline crew rates, travel agent rates and tour group escort rates) or other deeply discounted rates will not be considered qualifying rates toward member status. Complimentary or barter room stays or any stays booked through any third party online travel channel website (including, but not limited to: HotelTonight.com, Booking.com, Rocketmiles.com, Priceline.com, Expedia.com, Hotels.com, Hotwire.com, Lastminute.com, Travelocity.com, Orbitz.com, Travelweb.com) are considered as not qualifying and will not be eligible for credit.   
  • Neither Fairmont nor the Program is responsible for requests or correspondence lost or delayed in the mail. Fairmont is not responsible for, and reserves the right to correct, any pricing or typographical errors, errors of description, or errors regarding Participating Hotels and partners.   
  • It is the responsibility of the Member to report any lost or stolen membership cards or credit cards to the Program Guest Services Team at 1 877 232 7070 or fpcguestservices@fairmont.com immediately to avoid unauthorized use of the card.  Fairmont is not responsible for any charges incurred as a result of a lost or stolen membership card, unless the loss has been reported to Fairmont.   
  • Fairmont provides the Program with these Terms and Conditions and other materials, services and products “as is” and, to the fullest extent permitted by applicable law, expressly disclaims any warranties of any kind, express or implied, including, but not limited to, warranties of merchant ability, fitness for a particular purpose, design, accuracy, capability, sufficiency, suitability, capacity, completeness or availability. The Member agrees that Fairmont does not represent, warrant or guarantee that the Program or any such other products and services will be uninterrupted, without omissions or error free, or that defects will be corrected or changes implemented.
  • TO THE EXTENT LEGALLY PERMISSIBLE, A MEMBER AGREES TO INDEMNIFY, DEFEND, AND HOLD FOREVER HARMLESS FAIRMONT, ITS AFFILIATES, AND THE PARTICIPATING HOTELS AND THEIR RESPECTIVE SHAREHOLDERS, MEMBERS, DIRECTORS, OFFICERS, EMPLOYEES AND AGENTS (COLLECTIVELY THE “FAIRMONT PARTIES”) FROM AND AGAINST ANY AND ALL CLAIMS, CAUSES OF ACTION, LAWSUITS, LIABILITIES, DAMAGES, FINES, PENALTIES, EXPENSES AND COSTS (INCLUDING REASONABLE ATTORNEYS’ FEES) SUFFERED OR INCURRED BY ONE OR MORE FAIRMONT PARTY TO THE EXTENT ARISING OUT OF OR RELATING TO (A) A MEMBER’S PARTICIPATION IN THE PROGRAM, INCLUDING ANY REDEMPTION OF BENEFITS OR REWARDS; (B) A MEMBER’S FAILURE TO COMPLY WITH THESE TERMS AND CONDITIONS; (C) A MEMBER’S BREACH OF ANY WARRANTY WITH RESPECT TO ANY PROVISION IN THE TERMS AND CONDITIONS; AND (D) A MEMBER’S NEGLIGENCE OR WILLFUL MISCONDUCT.
  • TO THE EXTENT LEGALLY PERMISSIBLE, NEITHER FAIRMONT NOR ITS AFFILIATES NOR ANY PARTICIPATING HOTEL WILL BE LIABLE UNDER ANY CIRCUMSTANCES FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE PROGRAM, THE PROGRAM MATERIALS, MEMBER PARTICIPATION IN THE PROGRAM, OR MEMBER USE OF ANY FAIRMONT OR PROGRAM PRODUCTS AND SERVICES WHETHER DELIVERED BY FAIRMONT, THE PROGRAM, A PARTICIPATING HOTEL, OR A THIRD PARTY, EVEN IF CAUSED BY A FAIRMONT’S PARTY’S NEGLIGENCE OR WILLFUL MISCONDUCT, AND EVEN IF THE FAIRMONT PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  THIS INCLUDES LOST PROFITS OR REVENUES AND/OR LOST BUSINESS OPPORTUNITIES.  THESE EXCLUSIONS DO NOT APPLY ONLY IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES.  IF A FAIRMONT PARTY IS HELD LIABLE FOR ANY DAMAGES RELATED TO THE PROGRAM, PROGRAM MATERIALS, MEMBER PARTICIPATION IN THE PROGRAM, OR MEMBER USE OF ANY OTHER FAIRMONT OR PROGRAM PRODUCTS AND SERVICES, A MEMBER’S SOLE AND EXCLUSIVE REMEDY WILL BE LIMITED TO REIMBURSEMENT, FROM THE FAIRMONT PARTY HELD LIABLE, FOR SERVICES OR PRODUCTS PAID BY A MEMBER TO THE FAIRMONT PARTY HELD LIABLE.  
  • A MEMBER AGREES THAT CERTAIN SERVICES MADE AVAILABLE UNDER THE PROGRAM, MAY BE PROVIDED BY THIRD PARTIES UNRELATED TO FAIRMONT OR THE APPLIABLE PARTICIPATING HOTEL AND SUCH SERVICES MAY BE SUBJECT TO ADDITIONAL TERMS AND CONDITIONS. A MEMBER FURTHER AGREES THAT, UNLESS PROHIBITED BY LAW, NEITHER FAIRMONT NOR ANY PARTICIPATING HOTEL SHALL HAVE ANY LIABILITY FOR THE ACTS OR OMISSIONS OF ANY SUCH THIRD PARTY.
  • At the time of enrolling, Members will be given the opportunity to opt in to receiving Program communications by email.  The Program will send to those Members who consent to receive email communications regular Program communications including monthly statements, transactional emails, and various marketing communications.  The Program may also send Member promotions, offers, and other communications from time to time, which may include, without limitation, information and offerings about the services of Fairmont’s affiliates or third parties. A Member may choose to opt out of such communications at any time and free or charge by (a) logging onto a Member’s profile and selecting “Managing Subscriptions;” (b) following the "opt-in and out-out" instructions contained in direct communications; or (c) by contacting the Program’s Member Services at 1 877 232 7070 or +506 877 3194.
  • A Member may access and review his/her profile, status, available Certificates and benefits, and transaction history by visiting the Program website.  A Member will be required to enter in a user id and password to access the website.  When a Member contacts the Program’s Member Services, Fairmont may ask a Member certain security related questions to verify a Member’s identity.
  • The collection, accessing, use, and storage of a Member’s personal information will be governed by Fairmont’s privacy policy.  
  • Services and benefits may be subject to income or other taxes.  A Member is solely responsible for any tax liability, including disclosure, connected with participation in the Program, including the receipt or use of Certificates or other benefits. 
  • Membership is nontransferable under all circumstances including death, divorce, and bankruptcy.  This restriction applies to any associated benefits associated with membership status, Certificates or other benefits.
  • These Terms and Conditions shall be governed and interpreted in accordance with the national and local laws of the Province of Ontario, Canada (excluding conflicts of law principles).  Any disputes between a Member and Fairmont or any Fairmont Party arising out of or related to these Terms and Conditions, including Member’s participation in the Program, shall be brought in the courts of the Province of Ontario, Canada, and a Member’s participation in the Program demonstrates consent to the exclusive jurisdiction of such courts over such matters.
  • The Program, and any Certificates or other benefits, are void or otherwise inapplicable where prohibited or restricted by applicable laws.
  • FOR EU AND QUEBEC RESIDENTS ONLY. Those Sections authorizing Fairmont to unilaterally (i) revoke, suspend or discontinue a Program membership; (ii) add, modify, suspend, delete or change these Terms and Conditions, status qualifications, services or benefits; or (iii) interpret these Terms and Conditions, or requiring a Member to bring a dispute with Fairmont arising out of these Terms and Conditions to courts of the Province of Ontario do not apply to EU or Quebec residents.  Notwithstanding the foregoing, Fairmont reserves the right to modify, at any time and at its discretion, these Terms and Conditions by sending a Member a written notice at least thirty (30) days before the modification comes into effect. Use of the Program after the effective date indicated in the notice will constitute acceptance by the Member of the modifications contained in such notice.
  • FOR QUEBEC RESIDENTS ONLY.  These Terms and Conditions shall be governed and interpreted in accordance with the national and local laws of the Province of Québec, Canada.  Any disputes between a Member and Fairmont or any Fairmont Party arising out of or related to these Terms and Conditions, including a Member’s participation in the Program, shall be brought in the courts of competent jurisdiction located in the district of Montreal, Québec.
  • FOR EU RESIDENTS ONLY.  Any disputes between a Member and Fairmont or any Fairmont Party arising out of or related to these Terms and Conditions, including a Member’s participation in the Program, shall be brought in the courts of competent jurisdiction of the state of residence of the Member.
  • By enrolling and participating in the Program, a Member agrees that a Member must bring or assert all claims arising out of or relating to the Program or any element or portion of it, including these Terms and Conditions, within one year, to the extent legally permissible, after the facts giving rise to such claim occur.
  • Each Member hereby explicitly waives any and all rights to bring or assert any such claim after that stated time period.
  • Neither Fairmont nor the Program is responsible for requests or correspondence lost or delayed in the mail, or any losses or damages that may arise due to the loss or delay of requests or correspondence.
  • If a court of competent jurisdiction determines that any term or provision of these Terms and Conditions is invalid, illegal, or incapable of being enforced, all other terms and provisions of these Terms and Conditions shall remain in full force and effect so long as the economic or legal substance of the transactions contemplated herein is not affected in a manner that is materially adverse to either party to the Terms and Conditions.
  • Fairmont’s failure to insist upon strict adherence to any term or condition within these Terms and Conditions shall not be construed as a waiver of any subsequent violation of the same or any terms or conditions of a similar nature. 
  • The parties have expressly requested that these Terms and Conditions be drafted in the English language.  Les Parties ont expressément requis que les présents termes et conditions soient rédigés en anglais.
  • These Terms and Conditions, including all the terms and conditions incorporated by reference, constitute the entire agreement between a Member and Fairmont as to the subject matter discussed in them. Except for Fairmont’s ability to unilaterally modify these Terms and Conditions and/or the Program without a Member’s consent, or as otherwise explicitly set forth in these Terms and Conditions, the agreement between a Member and Fairmont may not be altered or amended except by a written document signed by both a Member and Fairmont. These Terms and Conditions supersede and render invalid any other arrangements, agreements or promises, whether written or oral, which may have been made by one party to the other; any superseded arrangements, agreements or promises shall have no further force or effect.
